Each of the panelists are involved in the Lane v. Brown case that challenged Oregon’s segregation of individuals with intellectual disabilities in sheltered workshops in violation of the ADA. Segregated day habilitation is not the same as segregated work and combining a challenge to both in one initiative -- at least one Olmstead case -- is complicated, risky, expensive, politically divisive, and very difficult to prove. However, it is essential to ensure that phasing down/out segregated employment does not result in movement from segregated work to segregated day, so any integrated employment initiative must develop proactive remedies to prevent trans-institutionalization.
